Too cynical. Very few people who are found by the police to have committed an offence are prosecuted. The primary test once the evidence is collected is to establish public benefit from prosecution. Hard to see that this prat's likely to do it again. He doesn't need persuasion that this was wrong: there isn't a driving need to establish a pattern of offending using this offence. He certainly won't do this again as a government advisor, he's already had to jack that in.
